1. Agreement to Terms

These Terms of Service ("Terms") govern your participation in the AdMontix Affiliate Network (the "Network"). By registering as an affiliate or using the Network's services, you agree to these Terms. If you do not agree, do not use the Network.

2. Definitions

  • Company: AdMontix, owner and operator of the Network.
  • Affiliate: Any approved individual or entity promoting offers.
  • Advertiser: A merchant or brand whose offers are promoted.
  • Offer: A product, service, or campaign listed for promotion.

3. Eligibility and Account Registration

Affiliates must be at least 18 years old and legally authorized to enter agreements. You agree to provide accurate information and maintain account integrity. The Company may approve or reject applications at its discretion.

4. Affiliate Obligations

  • Promote offers legally and truthfully.
  • Comply with advertising and privacy laws.
  • Avoid fraudulent or deceptive marketing.
  • Provide disclosures when required by law.

5. Qualified Actions & Payments

  • A Qualified Action must come through the provided Link and represent a real person, not automated traffic.
  • Commission payments are made monthly for accounts with balances over $100.00. Balances under $100 will roll over until the threshold is reached.
  • AdMontix's obligation to pay is contingent on receiving funds from Clients for the relevant Offers.
  • Payout methods and payment schedules will be listed in the affiliate dashboard and are subject to verification.

6. Confidentiality

All confidential business information provided as part of the program remains confidential and may only be used to perform under this Agreement. Affiliates must not disclose trade secrets, pricing, or other proprietary information without written permission.

7. Fraud

Fraudulent behavior including automated clicks, cookie-stuffing, fake leads, or other deceptive practices is strictly prohibited. If we detect fraud, we may withhold payments, reverse commissions, suspend or terminate accounts and take legal action where appropriate.

8. Anti-Spam & Marketing Rules

All email marketing must comply with applicable anti-spam laws such as CAN-SPAM. Affiliates must not use unauthorized lists, harvested contacts, or misleading subject lines. Paid media and partners must be disclosed to AdMontix if required by the Offer.

9. License & Intellectual Property

We grant a limited, non-transferable license to use AdMontix creative assets and tracking links strictly as provided. You may not alter, rebrand, or create derivative works of our assets without permission. All other trademarks remain the property of their owners.

10. Termination

The Agreement begins on the date of acceptance and continues until terminated. Either party may terminate by written notice or by removing Links from Media. Upon termination, Affiliates must cease using AdMontix assets and return or destroy confidential materials.

11. Disclaimers & Limitation of Liability

The Affiliate Program and Links are provided "as is." AdMontix disclaims all warranties except those expressly stated. Our aggregate liability is limited to commissions paid to the Affiliate in the six months prior to the claim. We are not liable for indirect or consequential damages.

12. Governing Law & General Provisions

This Agreement constitutes the full agreement between the parties. Affiliates act as independent contractors. Any dispute shall be governed by applicable law chosen by AdMontix, and if required, resolved in an appropriate jurisdiction.
